This position is located in the Patent Trial and Appeal Board (“Board”). The Patent Trial and Appeal Board Executive (Board Executive) is responsible for executive level management and direction of all functions of the Board and is directly involved in supporting the Board’s statutory judicial duties. The incumbent is responsible for planning and directing a broad range of legal, judicial, administrative, and support services. The incumbent will work closely with the Chief Administrative Patent Judge (Chief Judge) and Deputy Chief Administrative Patent Judge (Deputy Chief Judge) to develop and map the long-term strategic direction of the Board and be relied upon to be involved and provide advice to the Chief Judge and Deputy Chief Judge on all day-to-day management decisions.

The Board Executive is an executive-level position that directly oversees the operation and administration of the Board. The Board Executive serves as the focal point through which all programs and projects/actions of the office receive effective central coordination and review. Decisions made by the Board Executive include determining resources to be expended, the timing of major events, the priority of projects and plans, and deciding which projects should be initiated, dropped, or postponed. The Board Executive ensures that appropriate long-range planning is coordinated and accomplished, and that there is maximum and efficient utilization of available resources. An understanding of the nature of the Patent Trial and Appeal Board’s mission and the matters that come before it is preferred.

The Board Executive shares responsibilities for carrying out the full range of management responsibilities and acts with full authority over the office functions and activities. The Board Executive recommends courses of action to the Chief Judge and the Deputy Chief Judge providing legal advice with respects to questions regulations, practices or other matters falling within the purview of the Board and has full responsibility and authority to determine policies, plans, goals, organization, and administrative courses of action. The Board Executive also manages and directs major program functions and activities to achieve consistency of operations reviewing legislation and/or policies for consideration and adoption by agency officials and makes substantive recommendations as needed.

More specifically the incumbent will:

  • Speak authoritatively in meetings with top USPTO officials, representatives of other government agencies and other outside groups. Acts as a liaison between Federal Circuit Court and attorneys, bar associations, and the public. Advises attorneys and judges on procedural matters related to filings.
  • Effectively oversee and direct case management, including intake of matters before the Board, docketing, data system updates, administratively preparing matters for decision, and mailing of final decisions.
  • Provide judicial support, including paralegal operations and all types of support to the various Lead Judges and other management of the Board.
  • Coordinate oral hearing operations, including docketing, scheduling, notification, requests for relief, court reporter management, and transcript management.
  • Be responsible for providing advice on the full range of administrative and human resources functions including, but not limited to, strategic human capital planning, labor relations management, contracts, agreements, workforce planning and financial management.
  • Be responsible for conducting studies relating to the business and administration of the Board and preparing appropriate recommendations and reports to the Chief Judge and Deputy Chief Judge.
  • Be responsible for collecting, compiling, and analyzing statistical data with a view to the preparation and presentation of reports based on such data as may be directed by the Chief Judge and Deputy Chief Judge.
  • Attend Lead Judge meetings, providing guidance and advice when necessary.

Qualifications and Evaluations

Due to the complexity of this position, it is preferred that the Board Executive possess a law degree. Additionally, the Board Executive should possess significant work experience in court management. Experience in the field of patent law and intellectual property is also highly desirable.
You will be evaluated on the quality and extent of your total accomplishments, experience, and education. Your application will be evaluated by a rating and ranking panel, and highly qualified candidates will be submitted to the Selecting Official for further review and consideration. Applicants must clearly demonstrate in their application materials that they possess technical attributes in the Professional/Technical Qualifications (PTQs). In addition, applicants must clearly demonstrate that they possess the leadership attributes in the Executive Core Qualifications (ECQs). Each PTQ and ECQ should be addresses separately and narratively. You must address each PTQ/ECQ when prompted. Do not type "See Attachment" or "See Resume".

The PTQs for this position are:

1. Knowledge and demonstrated experience in the organizational and administrative planning of an intellectual property operation and/or an adjudicatory operation.

2. Demonstrated executive level experience in directing, supervising and evaluating the activities of a professional, technical and legal organizational unit.

3. Experience in overseeing operations of a complex organization through managing and coordinating multiple resources. This will include human resources, budget resources and information technology resources.

4. Demonstrated ability to operate effectively in a time-sensitive environment that required the ability to prioritize projects; giving direction and coordination to multiple projects simultaneously and work within and across business lines to ensure that organization needs were met.

The ECQs for this position are:

1. Leading Change- This core qualification involves the ability to bring about strategic change, both within and outside the organization, to meet organizational goals. Inherent to this ECQ is the ability to establish an organizational vision and to implement it in a continuously changing environment.

2. Leading People- This core qualification involves the ability to lead people toward meeting the organization's vision, mission, and goals. Inherent to this ECQ is the ability to provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports constructive resolution of conflicts.

3. Results Driven- This core qualification involves the ability to meet organizational goals and customer expectations. Inherent to this ECQ is the ability to make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks.

4. Business Acumen- This core qualification involves the ability to manage human, financial, and information resources strategically.

5. Building Coalitions- This core qualification involves the ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.
Each response to the PTQs & ECQs must include a narrative summary of the applicant's executive experience in relation to the PTQs & ECQs and specific examples of accomplishments. Failure to address each qualification factor will have an adverse impact upon your ranking.

Probationary Period: You will be required to serve a one-year probationary period unless you previously completed the probationary period in the SES.
